Eligibility
The Cayemay Picture Contest (KMA Picture contest) is open to legal residents of the fifty United States, and the District of Columbia who are at least eighteen (18) years old at the time of entry into the picture contest. Entry into the contest and usage of Cayemay.com is subject to the Cayemay Privacy Policy and Terms & Conditions Please review these policies that governs our relationship and informs users of rules, regulations and policies prior to using the cayemay.com website or entry into our picture contest. Employees of Cayemay.com and other companies associated with the promotions of the contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The contest is subject to federal, state, and local laws and regulations. By entering or voting in the contest that participation constitutes full and unconditional agreement to these rules, the Cayemay Privacy Policy and the Cayemay Terms of Conditions.
How to Enter
To enter into the KMA photo contest a contestant must submit their own photograph (no group submissions each photograph should show only one individual), name and e-mail address (used to contact winners of the contest) at our Picture contest entry page. Each submission will be eligible for the current month after their picture is received. In the event that there are too many submission for the current month the contestant will be eligible for the contest for the next month. There is a limit of one photo submission per person, per e-mail address and per household per month. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become property of Cayemay.com.
Voting and General Conditions
Voting will occur by each visitor to the website casting their vote by selecting the vote for check box, and clicking on the submit button; therefore, casting their vote for that entrant. Only one monthly vote per household is allowed. Any entrant or person manipulating the vote by casting multiple votes, or otherwise attempting to manipulate the voting system will be eliminated and banned from the contest (the contestant in question will be subject to this penalty) and removed from prize eligibility. In addition, in the event that the operation, security, or administration of the contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the contest is unable to run as planned for any other reason, as determined by cayemay.com in its sole discretion, cayemay.com may either a) suspend the contest to address the impairment or b) terminate the contest and, in the event of termination, award the prize at random from among the eligible entries received up to the time of the impairment. Cayemay.com and/or the sponsor reserves the right in its sole discretion to disqualify any individual(s) it finds to be tampering with the entry process or the operation of the contest or to be in violation of these rules or in an unsportsmanlike or disruptive manner. Any attempt by any person(s) to damage the website or undermine the legitimate operation of the contest may be in violation of criminal and civil law, and, should such and attempt be made, cayemay.com reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by cayemay.com to enforce and provision of these conditions shall not constitute a waiver of that provision.
Prizes
Winner must meet all eligibility requirements. Prizes may vary from $50.00 to $5,000.00 US dollars based on number of participants and votes received. In the event the winner is deemed ineligible, or is not available to claim prize during specified dates, then an alternate winner will be selected at random from eligible entries received, time permitting. On or about the 1st of each month, cayemay.com will select a potential winner that receives the most votes during the previous voting month from all of the eligible entries that are received. The odds of being selected depend on the number of entries received, and the amount of votes that are cast. Cayemay will attempt to notify the potential winner via email and if the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, cayemay.com may select an alternate potential winner in his/her place based on the amount of votes aquired from the remaining non-winning, eligible entries. By accepting the prize, the winner acknowledges compliance with these photo contest rules.
Submission Restrictions
By entering the contest, each contestant warrants that their submission is an original work owned by the entrant; and grants cayemay.com and its designee(s) the perpetual, unlimited, non-exclusive, worldwide and irrevocable right to modify, create derivative works of, edit, post, publish and/or otherwise use the submission and all elements embodied therein. This includes usage in any manner and in any and all media now known or hereafter developed, without compensation, notification, permission and frequency or duration of use including, without limitation in advertising, promotion and on the internet. A Submission must: 1) Be an original work solely owned by the entrant; 2) Contain only one individual in each photograph; 3) Be a .jpg, .gif, .jpeg or .png file format that is 250 x 250 in height and width, and does not exceed 3MB; 4) have been created legally and not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity. Contestant agrees that cayemay.com, Cayemay Entertainment Outlet LLC and their employees shall not have any liability to entrant for any direct, indirect, contributory, vicarious, secondary or other infringement or protection of any copyright in or to entrant's submission. Cayemay.com has the right to review all submissions and all submissions may be posted on the cayemay.com website at sole discretion of the cayemay.com staff. By making a submission, entrant hereby grants permission for the submission to be posted on the cayemay.com website, and otherwise be used by the cayemay.com staff in accordance with the grant of rights set forth above. Entrant agrees that cayemay.com are not responsible for any unauthorized use of submissions by third parties. E-mail information collected may be used for promotional marketing. Please see our Privacy Policy. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries; any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, or software; failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including but not limited to any injury or damage to the entrant or any other person(s) computer related to or resulting from participation in this contest.
Release and Limitations of Liability
By participating in the contest, entrants agree to release and hold harmless the sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents from and against any claim or cause of action arising out of participation in the contest or receipt or use of the prize. Including, but not limited to: a) any technical errors associated with the contest including lost, interrupted or unavailable internet service provider (ISP), network, server wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; b) Unauthorized human intervention in the contest; c) mechanical, network, electronic, computer, human, printing or typographical errors; d) any other errors or problems in connection with the contest, including , without limitation, errors that may occur in the administration of the contest, the announcement of the winner, the cancellation or postponement of the contest and/or the flyover, if applicable, or in any contest-related materials, advertisements and/or promotions; f) injury, death, losses or damages of any kind to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the contest or the acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associate with or utilized in the contest. Entrant waives the right to claim any damages whatsoever, including but not limited to, punitive, consequential, direct, or indirect damages.
